We have to thank Cycling Mikey (and others) for trying to keep our roads safe. 👍
He cut off the car and sped away. There were a lot of changes in the Highway Code in 2022. No touching phones, hands free phones must be in a holder. Pedestrians and bicyclists have priority at junctions. Camera footage can now be used for Zebra crossing offenders. Cyclists no longer need to keep to the left and don’t need to use cycle lanes. Cars need to give 1.5m clearing for bicyclists. Drivers must treat bicyclists like any other motorists when joining roads. Prior to 2022 motorists didn’t have to wait for a gap between their vehicle and the cyclists when joining a new road. You can also use your camera to report gap offenders as well. The Dutch reach is now recommended for car users opening doors. With Dutch reach the driver or passengers must use the arm furthest from the door when pulling the handle when getting out (wouldn’t apply to Teslas that are equipped with automatic door openers). This procedure forced one’s torso to rotate, increasing chances of seeing an approaching cyclist. And, you are now able to use your camera to report drivers who break box junction, traffic light, and give way rules. You can also report drivers making illegal U-turns.

Whilst speed limits may not apply to cyclists, I believe the offence of 'furious pedaling' remains on the statute books.
Town Police Clauses Act 1847 Section 28 states "Every person who rides or drives furiously any horse or carriage, or drives furiously.. ..shall be liable to a penalty.."
Precedent was set in Taylor v. Goodwin (1879) where it was upheld that a bicycle is carriage for the purposes of the interpretation of such legislation.
Perfect illustration that when you catch them using their phones whilst stationary, they’re using them whilst driving too and just continue to do so…..

I think that they see other people using the phone it has become the norm and acceptable to them.
Car insurance has gone through the roof and having to pay the extra must be very hard if caught using the phone.

Mikey, do the police only act when the phone screen is clearly recorded as lit as evidence of use (use is the legal test) or is evidence of the driver merely holding a phone enough for them to proceed usually ?

I have just re-read the latest version of Regulation 110, and I can't see it there.
But it did leave me with another question: If the device in use is resting on the driver's leg, but actually not being held in the hand at any point, does this still count as "hand held"?🤔

I commute to Birmingham for work and I'm positive the traffic wouldn't be as bad if people didn't use their phones, it's rife on all Birmingham streets.
Hi Mikey, you are very correct that “cyclists” cannot be prosecuted for exceeding the road speed limits, As such, However If they are involved in any road incident cyclists who breach the speed limit may not be prosecuted for a speeding offence but they can, however, be prosecuted for “cycling furiously” or “wanton and furious cycling.”
