What is going on everybody, this is TGA, and in today’s video, we’ve found another one of our videos from Scotland, with @AuditingYorkshire, thought I’d post this, as I want to know what all those of you from Scotland think, there’s no specific law in Scotland to prevent filming a court. So, is it illegal and could it be classed as contempt of court, I’m not sure, let me know your opinions below. Enjoy the video.

    1. To film inside a court in Scotland a fee is chargeable. Fees may be reduced if the event is by, or for, a registered charity or other non-profit purpose.
Any recording within the Supreme Courts is under the control of the Lord President, or in his absence, the Lord Justice Clerk. Any recording within the sheriff or justice of the peace courts is under the control of the sheriff principal.
Dont film anyone involved in a court case, this is perverting the course of justice, it may be witness intimidation.
Contempt of court and perverting the course have a custodial sentences, even in Scotland.

    2. I think you were really lucky not to get arrested then, those security guards were not daft and they knew you were just trying to get a rise out of them so luckily for you they weren't taking you too seriously. You really shouldn't show the faces of people coming and going from a court building, they could be witnesses, members of a jury, or judicial staff, you could be putting their safety and security at risk by broadcasting their faces, that is one of the reasons you are required to seek a permit to do some filming because one of the conditions of being granted permission is that you do not broadcast the identity of individuals without their permission, coming and going, by showing their faces, I think anyone with common sense and an inkling of some intelligence would understand that. There are protocols in place in Scotland, I'd strongly advise you to do some more thorough research because you broke those protocols which is why I'm saying you are lucky you didn't get arrested there and then ,and I'll be honest with you, if the Police who monitor the court building see your video they could still arrest you if you go back there, and I'll tell you why. The law in Scotland says that in relation to court buildings "no recognisable image of any individual may be broadcast without their express written/email consent, and if consent is not given you are required to blur out their faces." That would also be people coming and going from the court building ..and here is the critical point… " inside the court building and within the precincts of the court"…precincts of the court is interpreted as within the property line of the building, and you were clearly within the boundary of the property line by being on those steps. By broadcasting the faces of those people coming in and out the court building and the people within the precinct, you have broken the protocol which could still get you arrested. I would strongly advise you not to return there, but if you would care to challenge whether what I'm saying is correct or not, then go back there and remind them you were there before and that you have broadcasted images of people coming out the court building and see what happens.

    3. targeting and recording or sketching the likeness even ,of a specific member of the court ,witness etc with the intention of publishing in an attempt to jeopardize a case is contempt . recording in general is ok but if you capture a specific person and are told not to publish it and go ahead anyway then it becomes contempt . Probably one of the very few instances of public photography where the guidance of an official not to film specific persons should be followed .
Court officials need to create better privacy for these specific individuals where they are not in the public eye when entering or leaving the premises .

    4. One of the busiest courts in Europe and a half wit trying to be an American turns up to film. You're a very lucky guy that none of the people there for sentencing or for a case didn't thump you for filming. Get a life and a job. Absolute embarrassment.

    5. Seriously gwent auditor we all get it the video was about contempt of court because you said it enough, abit like where Kev got arrested few weeks ago. You do get yourself a little bit excited don't you 😂😂😂

    6. It's Allright saying "big up lads" to a prison van. Does that include any rapists, child molesters or pensioner beaters inside? I'd choose my words carefully.

    7. Love how they came out cig ready to light up! 😂😂 I bet in fact they were proper chuffed to see you both for an excuse to come outside for a ciggie. 😌 Are you sure you didn’t stumble on the set of Rab C Nesbitt? I can read the body language and temperament of a fag fiend became me mam was a 30 a day woman… Half hour without and she went from being a polite jokey Father Ted into an incomprehensible Father Jack! I guess that makes me a half Mancunian Dougal because me mam was from Limerick. I picked up that you were born in Yorkshire but grew up in Wales? Weird isn’t it? I feel like I should have an Irish accent but I sound like a girlie Karl Pilkington! Strange this world… nowt as funny as folk is there? Thanks for this Sam, Julie x
